Communications Tower

A company called Atlas Tower have made the Parish Council aware that they propose to erect a communications tower at a location along Gilberries Lane. They have provided a selection of photomontages to identify the impact, you can also see the exact location for the proposed mast here: https://w3w.co/drilling.acrobats.pranced. The mast will be available to multiple providers.

The erection and upgrading of many telecommunications installations do take advantage of permitted development rights, and Atlas Tower Group do benefit from permitted development rights for this proposal. However, due to the height of the proposed tower and the fact that this is a new cell site, the proposal requires something called prior approval. This is specific section of the permitted development rights under Schedule 2, Part 24 of the Town and Country Planning General Permitted Development Order 1995 (as amended) whereby Atlas Tower Group are required to apply to the local planning authority for a determination as to whether the prior approval of the authority will be required regarding the siting and appearance of the development. While not technically planning permission, we have to wait for the determination of the local planning authority before we can exercise our permitted development rights in this case. The local planning authority will respond in one of the following ways: ‘Prior Approval not required’, ‘Prior Approval required and granted’, or ‘Prior Approval required and refused’. They can only make their determination based on the siting and appearance of the proposed development and have 56 days from application to decide. If a determination of ‘Prior Approval not required’ or ‘Prior Approval required and granted’ is returned, Atlas Tower Group can then exercise their permitted development rights in the same manner as they would be able to for any proposal that does not require the prior approval of the local planning authority. Atlas Tower Group can also appeal a determination of ‘Prior Approval required and refused’ via the Planning Inspectorate, in the same manner as any refused planning permission.
